These Terms and Conditions govern the use of the Software, including the QUBO++ Library and any associated solver modules (collectively, “the Software”).
License Requirement: A valid license issued by the Provider is required for all uses of the Software, except as permitted under Section 2 (Trial Mode). This applies equally to commercial, educational, and research use.
Trial Mode (Evaluation-Only): Time-limited trial options may be made available for evaluation and testing purposes only and not for production or revenue-generating use:
Anonymous Trial (no license key): A license-free, time- and/or feature-limited mode may be enabled without registration.
Registered Trial (free trial license key): Upon registration, a free trial license key may be issued, subject to time and/or feature limitations.
The availability, scope, and limitations of either trial option may be modified or discontinued at any time. Circumvention or interference with trial limitations or license checks is prohibited. Use outside the scope of Trial Mode requires a valid and active license.
Authentication and Enforcement: License authentication may be performed at installation or runtime, and the Software may automatically switch between licensed mode and Trial Mode. Bypassing, altering, disabling, or otherwise interfering with licensing, authentication, or technical limitations is prohibited.
Scope of Use: Use is limited to the rights expressly granted in these Terms or in the applicable license, if any. Unless otherwise agreed in writing, any license is personal, non-exclusive, and non-transferable, and the Software may not be shared, sublicensed, or used on behalf of third parties.
Distribution and Modification: The form and delivery of the Software are determined by the Provider. Redistribution, public posting, or inclusion of the Software in other products or services without the Provider’s prior written consent is not permitted. Reverse engineering, decompilation, or disassembly is prohibited to the maximum extent permitted by law.
No Warranty: The Software is provided “as is,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, title, or non-infringement. No liability is assumed for any loss, damage, or claims arising from or related to the use of the Software.
Termination: Rights to use the Software may be suspended or revoked upon any breach of these Terms, unauthorized distribution, or attempts to circumvent licensing or Trial Mode limitations. Upon termination, all use of the Software must cease immediately.
Previous Versions: Earlier versions of QUBO++ may have been distributed under non-commercial or source-available terms. The current version is provided under a unified model that requires either a valid license or use strictly within Trial Mode as defined above.
